Appeal from a judgment of the County Court of Che-mung County, rendered January 12, 1979, upon a verdict convicting defendant of the crimes of burglary in the second degree, grand larceny in the third degree, and petit larceny. On February 10, 1978 after 9:00 p.m., a man entered the home of Violet Deibler on Seven Acres Road in the Town of Millport, Chemung County.
