Probate jurisdiction is within the jurisdiction of the Superior Court, but can be invoked only upon appeal from the Court of Probate, in which court original jurisdiction of this nature is vested. Upon such appeal the Superior Court acts as a probate court, exercising its powers and duties in respect to the matter defined in the appeal.
