I. Background
On August 4, 2010, plaintiffs Ferdinand Cruz-Mendez (“Cruz”) and his wife, Cruz Maria Cruz-Lopez (“Maria”), (collectively, “plaintiffs”) filed a complaint against defendant United States of America1 pursuant to the Federal Tort Claims Act (“FTCA”), 28 U.S.C. §§ 2671 et seq., and the Emergency Medical Treatment and Labor Act (“EMTALA”), 42 U.S.C. § 1395dd.
