In this wrongful death action based on diversity jurisdiction, plaintiff-appellant James Pennington, Administrator for the Estate of Ariis Pennington (“the Estate”), appeals the orders of the district court granting summary judgment in favor of defendant-appellee American Telephone and Telegraph Company (“AT & T”).
