This is an appeal from a judgment of conviction for the crime of manslaughter entered against defendant, Charles Stoddard, by the District Court of the Thirteenth Judicial District, the Honorable E. E. Fenton, Judge presiding.

On Sunday, October 4, 1964, Mr. and Mrs. Fred Allison unfortunately were driving east on U. S. Highway 10 in their 1963 Corvair.
