(dissenting.) — The appellee was a member of a partnership at Decatur, Ala., under the name of Knight, Henry & Co., which did business with the appellant during the cotton season of 1899 and 1900, and up to November of the latter year, when the said firm was indebted to appellant in a large sum; the amount being $20,000 or more. On the 2d day of October the appellee individually deposited with appellant $12,000, taking a certificate reciting such deposit and' that it ivas to bear interest at 3 per cent, if left for 12 months. In November it seems the appellee formed a corporation to succeed…
