Upon his conviction, in the recorder’s court of the city of Detroit, of the crime of attempt to commit burglary, petitioner, on the 31st day of May, 1905, was sentenced to the Michigan State prison at Jackson “for the period of not less than one year ” from and including the said 31st day of May.
