delivered the opinion of the court.

John L. Barnes was named as executor in the purported will of Margaret Crumbaker, deceased. The will was probated, and Barnes qualified as executor and performed the duties of that trust for more than a year, during which time he received as such executor several thousand dollars and expended substantial sums in the liquidation of claims against the estate and for legitimate expenses.
