This is an action under the Federal Employers' Liability Act to recover damages for the death of Henry H. Noce who was killed while in the course of his employment by defendant as a section laborer upon defendant's railroad tracks. The case was tried in the Circuit Court of the City of St. Louis and resulted in a verdict in favor of plaintiff executrix in the amount of $45,000. As a condition to the overruling of defendant's motion for a new trial the trial court required that plaintiff remit $20,000 which was done and thereupon judgment for plaintiff in the amount of $25,000 was entered from…
