This court's opinion of December 20, 1996, is withdrawn, and the following opinion is substituted therefor.

This case requires us to decide whether the Fair Dismissal Act, § 36-26-100 et seq., Ala. Code 1975, mandates a pretermination hearing before an employee is dismissed from his employment. The circuit court held that it does not; we hold that it does. Therefore, we reverse.
