delivered the opinion of the court.

This is an action of trespass on the case brought by the defendants in error against the plaintiff in the Circuit court of Grayson county. The defendant demurred generalfy to the declaration, which contained but a single count, and the plaintiffs joined in demurrer; and after argument, the said demurrer was overruled by the court. The defendant then pleaded “not guilty,” and the plaintiffs joined issue thereon.
