LOTTINGER, Judge.

This is a tort action for personal injuries sustained by Mary Sedotal, wife of Leodas J. Freyou, and a three year old child (the latter’s grand-child), Cheryl Ann Darcey, as a result of an automobile accident which occurred in the Parish of St. Martin on October 14, 1951, at about 4:15 o’clock A.M. The minor, Cheryl Ann Darcey, appears through her father, William Dar-cey. Joined as party defendants are: 1) Southern Farm Bureau Casualty Company, liability insurer of the automobile owned and operated at the time by the husband, Leodas J. Freyou; 2) A. R.
