I am unable to concur in the conclusion reached by Mr. Justice Sharpe in this case.

In 1855 the Detroit & Pontiac Railroad Company and the Oakland & Ottawa Railroad Company were consolidated by force of Act No. 140, Laws of 1855, as the Detroit & Milwaukee Railway Company. After being operated for several years under this title its name was changed by amendment to that of defendant.
