MEMORANDUM ON CROSS-MOTIONS FOR SUMMARY JUDGMENT
OBERDORFER, District Judge.
Defendant is under a preliminary injunction, entered against his predecessor, which restrains him from issuing leases to certain coal lands in Montana and North Dakota, pending decisions on cross-motions for summary judgment. 1 Those motions are now before the Court.
One of the plaintiffs, Chairman Udall of the House Interior and Insular Affairs Committee, suggests that the controversy is mooted by recent legislation which bars further lease sales in the area subject to the preliminary injunction until 90 days after…
