Olive W. Cummings died in Palm Beach County, March 26, 1934, her husband, H. T. Cummings, having predeceased her by a few hours. By consent of Willis E. Walker, the sole surviving heir of the deceased, the appellee, George F. Bensel, was appointed and qualified as administrator of her estate. Subsequent to his qualification as such Bensel found in the home of Mrs. Cummings certain writings which were apparently intended as her last Will and Testament.
