Appeal from Wayne; Donovan, J. Bill by Fred E. Gregory, surviving executor of the last will and testament of William Ten Eyck, deceased, against Anna M. Tompkins, Maria B. Sloss, and Sarah Tompkins, for a construction of said will. From a decree for defendant Anna, complainant and the other defendants appeal.

The bill of complaint is filed in this cause to obtain a construction of paragraph 7 of the will of Wil*206liam Ten Eyck, deceased. He left an estate aggregating about $235,000, which he disposed of by the will which is to be construed. Mr; Ten Eyck was an old man when he died. His heirs at law are a niece 17 years old, a nephew 5Ó years old, and five sisters, the youngest of whom is 64 years old, and the oldest 80 years old. A sister of Mr. Ten Eyck married Daniel D. Tompkins after the death of his first wife, who was the mother of Daniel D. Tompkins, Jr. This son married Anna M. Tompkins. He…
