MEMORANDUM OPINION

PROPST, District Judge.

This matter is before the court on defendants’ Motion for Summary Judgment filed July 12, 1988.

The facts in this case appear undisputed. A special election was held in the City of Birmingham, Alabama (City) on May 12, 1987. The purpose for this election was to submit a proposition to impose a one-half mill property tax for library enhancement and to levy a charge to all telephone subscribers for enhanced 911 emergency telephone service.
