' Mrs. Turnbull filed, in the superior court of Morgan county, a petition against F. C. Foster, L. H. Foster, and F. W. Foster, alleging that she and the defendants were tenants in common of certain described land in Morgan county, entitled each to a one-fourth interest therein, and praying for the appointment of *766partitioned to divide the land among the cotenants. Two of the defendants, F. C. Foster and L. H. Foster, filed an answer in the nature of a cross-bill, in which they admitted that they were tenants in common with Mrs. Turnbull and F. W.
