*526In an action to recover damages for personal injuries, etc., the defendant appeals from an order of the Supreme Court, Richmond County (Gigante, J.), dated December 18, 2002, which granted the plaintiffs’ motion for leave to serve an amended complaint and denied its cross motion for summary judgment dismissing the complaint.
Ordered that the order is reversed, on the law, with costs, the motion is denied, the cross motion is granted, and the complaint is dismissed.
