(additional opinion). Since writing the opinion in this case our attention has been called to Johnson v. Phillips, 85 Ark. 86, a case which was overlooked by counsel in the preparation of their briefs and by the court in considering and determining the case; It is now insisted that this case is in conflict with the opinion of the court, in the present case, and that our opinion should be modified so as to conform to the principles announced in it.
