Appellant was tried under an indictment which charged that, with malice aforethought and after deliberation and premeditation, he had shot and killed one George Miller. The jury returned the f ollowing verdict: “We, the jury, find the defendant, A. T. Jones, guilty as charged in the indictment and fix his punishment at death-in the electric chair.” Upon this verdict appellant was sentenced to death, and from that judgment is this appeal.
