Judgment, Supreme Court, New York County (Jerome Marks, J., at hearing, trial and sentence), entered November 30, 1987, convicting defendant, after a jury trial, of criminal sale of a controlled substance in the third degree and criminal possession of a controlled substance in the third degree and sentencing him, as a predicate felon, to concurrent indeterminate prison terms of from 4 V2 to 9 years, unanimously affirmed.
