Appeal by the plaintiff, Thomas Zeikus, as administrator, etc., from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 20th day of January, 1911, denying the plaintiff’s motion for judgment on the pleadings.

Miller, J.:
The defendant demurred to the complaint on the grounds that the court had no jurisdiction, and that the complaint did not state facts sufficient to constitute a cause of action. The action is brought to recover 'for the death of the plaintiff’s intestate, alleged to have been caused by the def endant’s negligence in the State of Florida. The plaintiff is a brother of the deceased, resides in this State and was appointed administrator by the Surrogate’s Court of the county of New York.
