This proceeding was commenced by ap " pellant filing a petition to sell certain real estate, to make assets to pay the debts of the decedent, Amey R. Brinson. Martha J. Brinson, the widow of- said decedent, filed her cross-complaint, alleging, in substance, that “Amey R. Brinson died intestate in said county of Montgomery, on June 4, 1894, leaving as his sole and only heirs at law his widow, Martha J.
