The defendant was convicted on April 7,1951, in the Criminal Branch of the City Court of Rochester in that he violated an ordinance of the City of Rochester, New York, limiting the speed of automobiles.

On December 19, 1951, the defendant moved in the Criminal Branch of the City Court of Rochester for the issuance of a writ of coram nobis to have the conviction set aside, the information dismissed and the fine imposed remitted upon the ground that the defendant, at the time of his arraignment, was not advised of the provisions of section 335-a of the Code of Criminal Procedure.
