—Proceeding pursuant to CPLR article 78 to review a determination of the respondents, dated June 28, 1991, which after a superintendent’s hearing, found the petitioner guilty of violating a rule of inmate conduct and imposed a penalty consisting of confinement to the special housing unit for a period of 485 days and the loss of six months good behavior allowance.

Ordered that the petition is granted, on the law, without costs or disbursements, the determination is annulled, the petitioner’s good behavior allowance lost as a result of the determination under review is restored, and the…
