This matter is before the court on Defendant Life Time Fitness, Inc.’s (Life *671Time) partial motion for summary judgment on Count I. For the reasons stated below, the motion for summary judgment is denied.
BACKGROUND
Antowine Locke (Antowine), now deceased, was allegedly a member of a health and fitness club (Club) owned and operated by Life Time. Plaintiff Tracy A. Locke (Locke) was the wife of Antowine.
