Appellant, the defendant, an unmarried woman, was indicted and convicted of murder by poisoning. The deceased was a surgeon and the defendant a specialist in pediatrics. The crime is charged to have been committed shortly after midnight on the morning of Friday, July 28, 1933, in the office of the deceased, the parties being there alone. The corpus delicti was established by a dying declaration made on the following Wednesday night, August 2d, the accusatory part of which was that “Dr. Dean gave me a drink of whisky with poison in it.” Cf.
