OPINION
OLIVER, Judge.
Harold Morelock, the defendant below, indigent and represented by court-appointed counsel, was convicted in the Criminal Court of Hawkins County of (1) first degree murder, for which he was sentenced to imprisonment in the State Penitentiary for 50 years, and (2) assault with intent to commit voluntary manslaughter, for which he was sentenced to the penitentiary for not less than one nor more than five years to be served concurrently with the murder sentence.
