Proceeding pursuant to CPLR article 78 to review a determination of the respondent State commissioner, dated May 18,1979 and made after a statutory fair hearing, which affirmed a determination of the local agency denying medical assistance to the petitioner under section 366 (subd 2, par [c]) of the Social Services Law, on the ground that petitioner failed to submit an application for medical assistance for her hospitalization for the period of April 28 to May 3,1978 at St. Vincent’s Medical Center.
