This is a writ of error sued out by John H. Akin and Estella Akin to reverse a decree of the probate court of Kane county authorizing the executor of the will of John J. Akin to sell real estate of the testator for the payment of debts. The plaintiffs in error filed an answer to the petition, denying that the deceased was the owner in equity of a part of the land sought to be sold, and alleging that a resulting trust existed in favor of his widow, the mother of the plaintiffs in error, to the extent of two-thirds of a ioo-acre farm, a part of such land.
