TIMBERS, Circuit Judge:

Lizardo Criollo appeals from a judgment entered on November 22, 1991 after a jury trial in the Eastern District of New York, Gerald E. Rosen, District Judge, of the Eastern District of Michigan, sitting by designation, convicting Criollo of one count of conspiring to distribute cocaine, in violation of 21 U.S.C. § 846 (1988), and one count of possession with the intent to distribute cocaine, in violation of 21 U.S.C. § 841 (1988). Criollo was sentenced to a 121 month term of incarceration on each count to run concurrently, followed by five years of supervised release on…
