This suit was filed as a contest of the result of the primary election in 1938. The parties were opposing- candidates for the office of county judge. The result of the said primary election, as certified by the election officers, was 985 votes for Horne and 923 votes for Fish. Upon a trial of this case the court found that there were 530 illegal votes cast for Horne, 445 illegal votes cast for Fish, and Fish was declared the nominee of the party and his name was ordered placed upon the ballot as such.
