McNutt v. Johansen

Supreme Judicial Court of Maine

1Opinion of the Court

ROBERTS, Justice.

Nadine Johansen appeals from a decision of the Superior Court, Cumberland County, denying her motion to strike a default and awarding judgment to the plaintiff, Dorothea McNutt. On appeal she argues, inter alia, that the presiding justice erred in denying her motion to strike the default and in refusing to allow her to present evidence at the hearing upon plaintiffs motion for default judgment. We conclude there was no abuse of discretion in denying Johansen’s motion to strike, and that the court acted in conformity with M.R.Civ.P. 55. Accordingly, we affirm the judgment.
