Appeal from, Chickasaw District Court. On the 2d day of April, 1862, the W. \ of section 28, township 97, range 13, was sold by the treasurer of Chickasaw county, for the delinquent taxes of 1858, 1859 and 1860, and in pursuance thereof deeds were duly executed to Pitt Cooke, under whom plaintiff claims. On the 27th of August, 1867, the aforesaid land was patented to Geo. W. Jones.
