RUSSELL, Judge.

In April 1990 the mother filed a petition for divorce in the Circuit Court of Houston . County. She was awarded pendente lite custody of the child; however, the court later ordered temporary custody to be placed with the father, with visitation rights for the mother.

On September 26, 1991, the mother filed a dependency petition in the Houston County Juvenile Court alleging that the child was in physical danger in the father’s care and requesting immediate custody. The juvenile court issued a pickup order; however, because the child could not be located it was not executed…
