FINDINGS OF FACT AND CONCLUSIONS OF LAW

This proceeding came before the Court upon a complaint filed by Winifred R. Lang (“Plaintiff’) to determine the dis-chargeability of a debt pursuant to 11 U.S.C. §§ 523(a)(2)(A), (B) and 523(a)(4). (Adv.Doc. 1.) David Wesley Vickers (“Defendant”) filed an answer and affirmative defense. (Adv.Doc. 5.) On October 26, 1999 the Court held a trial on all issues and granted Defendant’s Motion to Dismiss as to 11 U.S.C. § 523(a)(4). (Adv. Doc. 12.) The Court continued the trial until February 16, 2000.
