On October 8, 1970, a jury found Lonnie Franklin guilty of murder in the first degree. His motion for new trial was overruled January 6, 1971. He did not appeal. On March 23,1971, he filed a posteonviction Rule 27.26 motion to vacate the judgment of conviction. The motion was heard, overruled, and on appeal the Supreme Court decided against appellant on two points, but *956because the trial court failed to make specific findings of fact on a third issue (denial of right to appeal) the cause was remanded for findings on that issue.
