Baker, Chief Justice:

This is an appeal from the granting of a general order of reference based on the pleadings. Contained in the order of reference is the following statement :

“There is also pending in this cause a motion bn the part of the defendants for an order framing an issue on one of *538the questions arising under the pleadings. It is my understanding that this motion is abandoned.”
