This is an appeal from a jury verdict of “guilty” wherein the defendant was charged with first degree assault in the district court of Yellowstone County, before the Honorable Guy C. Demy, presiding judge.

The defendant was sentenced to twenty years at hard labor on May 13, 1966. After a denial of a motion for a new trial this appeal followed.
