This is an appeal from a judgment of the County Court in a proceeding to condemn for the use of appellee certain property belonging to appellant. Judgment was rendered upon a verdict of a jury condemning the property and awarding appellant $55,000 as the value thereof. Motions for new trial were filed both by appellant and appellee but were overruled and notice of appeal was given by both parties. Appellant perfected his appeal and filed assignments of error in the lower court and in proper time filed the record on appeal and his briefs in this court. Appellee did not…
