delivered the opinion of the court.

By this writ of error, the defendant, Kelly-Atkinson Construction Company, seeks to reverse a judgment for $4,000 recovered by the plaintiff.

The defendant filed a bill in equity seeking to enjoin the collection of this judgment, and secured a temporary restraining order which was dissolved when the case was heard and the bill was dismissed for want of equity.
