THE COURT.

In this death penalty case, a jury convicted defendant Sammy Marshall of one count of first degree murder (Pen. Code, § 187; all statutory references are to the Penal Code unless otherwise indicated), two counts of robbery (§ 211), two counts of attempted forcible rape (§§664, 261, subd. (a)(2)), and one count of kidnapping (§ 207). The jury found to be true special circumstance allegations that the murder was committed during the commission or attempted commission of robbery (§ 190.2, subd. (a) (17)(A)) and rape (§ 190.2, subd. (a)(17)(C)). Defendant was sentenced to death.…
