This was an action, originally brought before a justice of the peace in Henderson county, by Bobert Pence against The Toledo, Peoria and Warsaw Bailway Company, to recover the value of a heifer belonging to the plaintiff, and killed by defendants’ train of cars moving upon their road.
The action was brought under the act of March 25, 1869, extending the jurisdiction of justices of the peace and police magistrates, and on the allegation of neglect and failure on the part of the railway company to fence their track at the place where the injury occurred, the railway having been opened for use…
