It seems that in the year 1869, Henry Hartzog conveyed, by his deed, a tract of land, containing t8i acres, unto F. W. Fairey, in trust, first, for Mrs. A. S. M. Patrick, with power of appointment in her, but in case such power was not exercised, then to' her surviving children and their heirs at law at her death. On the 25th September, 1870, Mrs. Patrick died intestate, never having exercised any power of appointment, thus vesting said lands in her six daughters and one son, to wit: Mrs. M. R.
