Lee R. and Barbara Ellenburg appeal the dismissal of their lawsuit against Larson Fruit Company, Inc. We reverse and remand for entry of judgment in favor of Ellenburgs.

In September 1984, Lee R. Ellenburg purchased an apple orchard from Northwest Land Investment Company (Northwest Investment). The purchase was financed by a real estate contract with the seller.
