Appeal by the defendant, Annie D. Flynn, individually and as administratrix with the will annexed of John Flynn, deceased, from portions of a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the cleric of the county of Kings on the 13th day of July, 1904, upon the decision of the court, rendered after a trial at the Kings County Special Term, construing the. will of John Flynn, deceased.

We are asked to construe that portion of the will of John Flynn, deceased, which reads as follows:
“ I hereby give, devise and bequeath all the rest, residue and remainder of my estate, real and personal of which I may die seized, entitled to, or possessed of, unto my said executors hereinafter named as trustees, to them, and their successors, to have and to hold the same for the following uses, intents and purposes, viz.:
