The present action was instituted by plaintiff against the United States under *76the National Service Life Insurance Act of 1940, as amended, 38 U.S.C.A. § 801 et seq., claiming the proceeds of a policy issued thereunder on the life of Bernard Lynn Morton, who died while in the Military Service on or about May 11, 1945. The deceased in his application for the insurance named the plaintiff as the beneficiary, designating her as his “wife”.
