Assumpsit for the plaintiff’s salary, as minister of the parish, which was originally sixty-six pounds lawful money by the year ; and also for a further annual sum, claimed to be due by virtue of a parish vote passed in November, 1800, and called the stipulation. The declaration alleged that the salary and stipulation were in arrears for three years, ending the 18th of April, 1812. The cause was tried on the general issue ,at the sittings holden here after the present term by the Chief Justice, and a verdict found for the defendants. The plaintiff, as the Congregational minister of the first parish in Sandwich, has brought an action of assumpsit, to recover of the parish his stated salary for three years, ending the 18th of April, 1812 ; and also an annual addition to his original salary for the same time, which he claims under a parish vote passed since his settlement. On the trial of the general issue, a verdict was found against the plaintiff, who has moved for a new trial, for the misdirection of the judge before whom the cause was tried.
