POEEENBARGER, JuDGE:

J. Wesley Beatly was convicted of murder in the first degree without recommendation of imprisonment, in the circuit court of Preston County on the 20th day of December, 1900. A motion in arrest of judgment and to set aside the verdict and grant a new trial was overruled and sentence of death was pronounced against the prisoner, lie has brought the case here on a writ of error, claiming that the court erred in overruling a motion to quash the indictment and in overruling the motion to set aside the verdict, that the record does not show any plea-entered, that there was no…
